I Watched Two Cops Get On the Stand and Lie Under Oath Today



Where the hell do I even begin with this one? I'm not sure but I need to tell people about this! Here goes...

I went to court today for a motion to dismiss two misdemeanor charges of OUIL (drunk driving) and DWLS (driving on suspended) that are filed against me in the 97th District Court in Baraga County Michigan, USA.

Did I drink and drive and was my license suspended? Yes. But in my defense I only blew a .08, which is Michigan's legal limit. I truly did not believe I was intoxicated enough to be a danger to me or anyone else and I certainly didn't know that I would blow drunk driving. I also didn't know my license was suspended by the state for not paying 1 speeding ticket of 5 over the limit. No BS! Who the hell writes tickets for 5 mph over the limit anyway?

The Michigan State Police Officer who arrested me, wrote on the police report that I did not have any license plate lights on my truck as required by law. But when he pulled me over I asked him why I was stopped and he told me there was no lights on my plate, and when I got out of the car at his request, I saw that the right hand plate light was on. I questioned him about it at the scene and he told me that both lights need to be working. Now, in the state of Michigan, the law says and I quote...

Act 300 of 1949
257.686 Rear Lamps
Section 686
(2) "Either a tail lamp or a separate lamp shall be constructed and placed so as to illuminate with a white light the rear registration plate and render it clearly legible from a distance of 50 feet to the rear. A tail lamp or tail lamps, together with any separate lamp for illuminating the rear registration plate, shall be wired so as to be lighted whenever the head lamps or axillary driving lamps are lighted"

I clearly was well within the law by having only one working plate light. Yet he stopped me and arrested me on the basis that he filed in his report, saying I had no working license plate lights.

So my lawyer filed a motion to dismiss all charges based on the fact that I was driving in compliance of the law, as there is no bad driving noted; Making the stop of my vehicle a violation of the United States Constitution and the State of Michigan.

So I go to court today for this hearing and the two Michigan State Police Officers that stopped me, get on the stand and both say that I didn't have any working license plate lights, when I did. Now, I am definitely not naive when it comes to the court system here in the US but I never ever expected these police officers to get on the stand and lie under oath. I was absolutely shocked! They blatantly committed perjury, which made it my word against theirs.

I even went to court today prepared with a videotape that shows my truck at night from a distance of 50 feet and on that video you can clearly see and read my license plate with the one working plate light. I guess I should have known that the police would lie about how the stop went down. But the good news is that I got a continuance of my motion to dismiss granted and I have three people that can come to court and say that they saw my truck with that one light working on the night in question.

The passenger in my truck saw the plate light on the night I was stopped. The next morning when my girlfriend bonded me out of jail, we went to get the truck and we both looked at the plate again and she saw that the right hand light was working. Also, as soon as we picked the truck up, we went to my friend's house and he came and looked and saw the one working plate light.

I should have had these three come to court with me today but I didn't. Now I will have to have them subpoenaed for the next court date so they can all testify to seeing that one working plate light. Next time it's going to be 4 civilians against 2 cops. Who do you think the judge is going to believe now? He'll still probably side with the lying bastard cops.

You know what my biggest problem is with these cops taking an oath and getting on the stand in open court and lying is? How many other people have they done this to before me? Cops are supposed to help people and make sure the world runs right yet here are a couple of guys that have no problem bold faced lying to the public under oath. What kinds of cops are these? What kind of people are these cops?

I don't even really care what happens to me in this court case. I'm just fighting this on the principle that these police officers violated the law themselves by illegally stopping my vehicle on the night in question. I know I was wrong but I also know that they are wrong. Lying is always wrong, very very wrong and just because some people put a badge and a gun on in the morning, it doesn't make them above the law nor does it give them a right to lie.

I may have not had a drivers license and I was legally drunk (.08) when I was stopped by them but the fact still remains that I was stopped illegally.

There is a saying here in Baraga County Michigan where I live, "Come to Baraga County on vacation, and leave Baraga County on probation".

We need to be educated not punish or arrested or ticketed or put to death. True cops lie more than citizens. I think that peace officers have responsibility to educate citizens, and help citizens. The truth is peace officers are above citizens and they are always a peace officer 24/7 until they retire or quit but a peace officer is not above the law like citizens. So I say continue the court battle because peace officers will continue to break laws until they are stop.
